توضّح هذه السياسة موقفنا من استرجاع الأتعاب مقابل خدماتنا الاستشارية المهنية.This policy explains our position on refunds of fees for our professional advisory services.

1. نطاق السياسة1. Scope
تنطبق سياسة الاسترجاع هذه على جميع الخدمات الاستشارية والتحليلية التي تقدّمها أبعاد، بما في ذلك تحليل الأعمال، وتصميم مؤشرات الأداء، وتطوير العمليات، والاستشارات الإدارية، ما لم يُتّفق كتابةً على خلاف ذلك في العقد الخاص بالمشروع.This Refund Policy applies to all advisory and analytical services provided by ABAAD, including business analysis, KPI design, process development and management consulting, unless otherwise agreed in writing in the project-specific contract.
2. طبيعة الخدمات وعدم قابليتها للاسترجاع2. Nature of Services & Non-Refundability
خدمات أبعاد خدمات مهنية استشارية يبدأ تنفيذها فور الاتفاق عليها، وبالتالي فهي غير قابلة للاسترجاع بعد بدء العمل، وذلك استناداً إلى نظام التجارة الإلكترونية السعودي ولائحته التنفيذية التي تستثني الخدمات التي بدأ تنفيذها بموافقة العميل من حق الاسترجاع (المادة 19).ABAAD's services are professional advisory services that begin execution upon agreement; they are therefore non-refundable once work has started, in accordance with the Saudi E-Commerce Law and its implementing regulations, which exclude services whose execution has begun with the client's consent from the right of withdrawal (Article 19).
يعود ذلك إلى أن قيمة الخدمة الاستشارية تكمن في الوقت والخبرة والجهد التحليلي المبذول، وهو ما لا يمكن استرداده بمجرد الشروع في العمل.This is because the value of an advisory service lies in the time, expertise and analytical effort invested, which cannot be recovered once work has commenced.
3. متى تُعتبر الخدمة قد بدأت3. When a Service Is Considered Started
تُعدّ الخدمة قد بدأت بمجرد وقوع أيٍّ مما يلي:A service is considered started once any of the following occurs:
- تخصيص فريق العمل أو الشروع في جمع البيانات والتحليل.Assigning the work team or beginning data collection and analysis.
- عقد أول اجتماع عمل أو جلسة اكتشاف مع العميل.Holding the first working meeting or discovery session with the client.
- تسليم أي مخرج أولي أو مسودة تقرير.Delivering any preliminary output or draft report.
- حلول تاريخ بدء التنفيذ المتفق عليه بعد تأكيد التعاقد والسداد.The lapse of the agreed start date after confirmation of the engagement and payment.
4. الإلغاء قبل بدء التنفيذ4. Cancellation Before Start
إذا رغب العميل في إلغاء المشروع قبل بدء أي عمل فعلي عليه، فيحق له استرداد المبالغ المدفوعة بعد خصم أي رسوم إدارية أو مصاريف فعلية تكبّدتها أبعاد في مرحلة التحضير، إن وُجدت. ويجب تقديم طلب الإلغاء كتابةً عبر البريد الإلكتروني الرسمي.If the client wishes to cancel the project before any actual work has begun, the client is entitled to a refund of amounts paid after deducting any administrative fees or actual costs incurred by ABAAD during the preparation stage, if any. Cancellation requests must be submitted in writing via the official email.
5. الحالات الاستثنائية5. Exceptional Cases
في حالات استثنائية محدودة، قد تنظر أبعاد — وفق تقديرها المطلق — في استرداد جزئي أو حلول بديلة (مثل إعادة تنفيذ جزء من العمل أو منح رصيد خدمة)، وذلك إذا ثبت وجود إخلال جوهري من جانبنا في تقديم الخدمة المتفق عليها. ولا يُنشئ هذا البند أي التزام تلقائي بالاسترداد.In limited exceptional cases, ABAAD may consider — at its sole discretion — a partial refund or alternative remedies (such as reworking part of the deliverable or granting a service credit), where a material failure on our part in delivering the agreed service is established. This clause does not create any automatic obligation to refund.
6. الشكاوى وحل النزاعات6. Complaints & Dispute Resolution
نحرص على رضا عملائنا؛ فإذا كانت لديك ملاحظة على جودة الخدمة، يُرجى التواصل معنا كتابةً خلال مدة معقولة من تسلّم المخرجات، وسنسعى لمعالجة الأمر ودياً في أقرب وقت. وفي حال تعذّر الوصول إلى تسوية ودية، يُحال النزاع إلى الجهات القضائية المختصة في المملكة.We care about our clients' satisfaction; if you have a concern about the quality of a service, please contact us in writing within a reasonable period of receiving the deliverables, and we will seek to resolve the matter amicably as soon as possible. Should an amicable settlement not be reached, the dispute shall be referred to the competent judicial authorities in the Kingdom.
7. القانون الحاكم7. Governing Law
تخضع سياسة الاسترجاع هذه لأنظمة المملكة العربية السعودية، بما فيها نظام التجارة الإلكترونية ولائحته التنفيذية، وتختص محاكم مدينة الرياض بالنظر في أي نزاع ينشأ عنها.This Refund Policy is governed by the laws of the Kingdom of Saudi Arabia, including the E-Commerce Law and its implementing regulations, and the courts of the city of Riyadh have jurisdiction over any dispute arising from it.
